Tax Incentives for Donated Easements Extended

With the passage of the Food, Conservation and Energy Act of 2008, the expanded tax incentives for conservation easement donations have been extended through the end of 2009 and made retroactive to January 1, 2008.

Known as the "farm bill," this act restores the incentives that had expired at the end of 2007 with the same terms: raising the annual deduction limit for donated conservation easements to 50% of adjusted gross income--100% for qualified farmers and ranchers--and extending the time period for using the deduction from 6 years to 16 years.
